Revision of the Dispositional Order
Wis. Stat. § 938.363

Request for Revision

  • Any person or agency bound by the dispositional order or the D.A. may request a revision of the dispositional order that does not require a change of placement.
  • The court on its own motion may propose such a revision.
  • The request must allege that new information is available.
  • The court shall hold a hearing if the proposed revision is contested.
  • The juvenile, counsel, parents, etc. shall receive notice of the proposed revision at least 3 days before the hearing.

Contested Revision Hearing

  • Any party may present relevant evidence.
  • The rules of evidence do not apply.
  • The burden of proof is clear and convincing.

Examples of Revision Requests

  • Adding no contact orders        
  • Require Day Treatment
  • Require Intensive Supervision
  • Require specific treatment program
